The vote was on a procedural motion to proceed to consideration of the bill and Senate rules dictate that 60 votes were necessary for passage. The final vote was 51-48 and broke down almost entirely along party lines. While this legislation appears to have been turned back this year, it will likely come before Congress again if Democrats retain control after the 2008 elections.
